Can I use Digital Notarization in BC?

In British Columbia, notaries can use electronic signatures and digital seals for certain documents. They must however follow the BC Electronic Transactions Act and maintain security and authenticity standards.
Recent changes allow for remote witnessing of Wills and Powers of Attorney in British Columbia. This was originally introduced as a temporary measure during COVID-19 and has been made permanent under provincial legislation. During a remote signing, a notary must be able to verify your identity and witness your signature in real time through secure video conferencing.
It is important to note that not all legal documents qualify for digital or remote notarization. For example, land title documents still require a in-person signing with original signatures in order to meet Land Title Office requirements.
Before choosing a digital or remote service, it’s important to confirm with your notary which documents are eligible, what technology will be used, and what steps are required to ensure compliance. This will help you avoid delays or having your documents rejected.
